Legal Notices: CITY OF LA CA'ADA FLINTRIDGE PUBLIC NOTICE OF ORDINANCE SUMMARY NOTICE IS HEREBY GIVEN that on June 6, 2017, the City Council of the City of La Caada Flintridge, California, introduced an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA CA'ADA FLINTRIDGE, CALIFORNIA AMENDING CHAPTER 11.33 TO TITLE 11 OF THE LA CA'ADA FLINTRIDGE MUNICIPAL CODE TO AMEND REGULATIONS GOVERNING ACCESSORY DWELLING UNITS (ZONE CHANGE 17-02) The proposed Ordinance (Ordinance No. 460) will amend or add the following sections of the La Caada Flintridge Municipal Code for the reasons stated below: Title 11, Chapter 11.33 is amended throughout to reflect that the term "Accessory Living Quarters" is being replaced by "Accessory Dwelling Unit." Section 11.33.020 is amended to reflect that accessory dwelling units are not a permitted use on a foothill community district (FCD). Section 11.33.020(J) is amended to reflect that no setback shall be required for an existing garage that is converted to an accessory dwelling unit, and a setback of no more than five feet from the side and rear lot lines shall be required for an accessory dwelling unit that is constructed above a garage. Section 11.33.020(O)(1) is amended to reflect that parking requirements are exempt as provided by subsection (3) of Section 11.33.020(O). Section 11.33.020(O)(2) is added to reflect that when a garage, carport, or covered parking structure is demolished in conjunction with the construction of an accessory dwelling unit, or is converted into an accessory dwelling unit, and the city requires those offstreet parking spaces be replaced, the replacement spaces may be located in any configuration on the same lot as the accessory dwelling unit, including, but not limited to, as covered spaces, uncovered spaces, or tandem spaces, or by the use of mechanical automobile parking lifts. Section 11.33.020(O)(3) is added to reflect that no additional parking requirements for accessory dwelling units are required in any of the following instances; (i) The accessory dwelling unit is located within one-half mile of public transit, (ii) the accessory dwelling unit is located within an architecturally and historically significant historic district, (iii) the accessory dwelling unit is part of the existing primary residence or an existing accessory structure, (iv) when on-street parking permits are required but not offered to the occupant of the accessory dwelling unit, (v) when there is a car share vehicle located within one block of the accessory dwelling unit. Section 11.33.030 is replaced with the following, "Notwithstanding any other provision of this chapter, the city shall ministerially approve an application for a building permit to create within a single-family residential zone one accessory dwelling unit per single-family lot if the unit is contained within the existing space of a single-family residence or accessory structure, has independent exterior access from the existing residence, and the side and rear setbacks are sufficient for fire safety. Section 11.33.030 is renumbered to Section 11.33.040. The City Council will conduct a second reading and consider the adoption of, Ordinance No. 460 on June 20, 2017.
