CITY COUNCIL OF THE CITY OF LA CAnADA FLINTRIDGE NOTICE OF PUBLIC HEARING July 7, 2018 NOTICE IS HEREBY GIVEN that on Tuesday, July 17, 2018, at 6:00 p.m., or as soon thereafter as the case may be heard, the City Council of the City of La Canada Flintridge will conduct a public hearing in the Council Chambers, 1327 Foothill Boulevard, La Canada Flintridge, California, 91011 to consider the adoption and issuance of the 10-day Report on Ordinance No. 469-U, adopting a 45-day moratorium on the issuance of permits for multifamily development within the Community Planned Development zone and the following: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA CAnADA FLINTRIDGE, CALIFORNIA, EXTENDING BY 10 MONTHS AND 15 DAYS THE ORIGINAL 45 DAY MORATORIUM ESTABLISHED BY INTERIM ORDINANCE NO 469-U, PROHIBITING OF ANY NEW PERMIT AS DEFINED HEREIN PERTAINING TO ANY MULTIFAMILY DEVELOPMENT IN THE COMMUNITY PLANNED DEVELOPMENT ZONE AND DECLARING THE URGENCY THEREOF AND THAT IT SHALL TAKE EFFECT IMMEDIATELY Government Code Sections 36934, 36937 and 65858 expressly authorize the City Council to impose, or extend, a moratorium for the immediate preservation of the public peace, health or safety and to prohibit a use that is in conflict with a contemplated general plan, specific plan, or zoning proposal that the legislative body, planning commission or the planning department is considering or studying or intends to study within a reasonable time. Staff has determined that this action is exempt from the provisions of the California Environmental Quality Act because this proposed ordinance is not a project within the meaning of Sections 15060(c)(3) and 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, either directly or indirectly. Alternatively, this ordinance is also exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, since the proposed ordinance involves a temporary moratorium on the issuance of permits, licenses, approvals, or entitlements and it is clear that there is no possibility that the ordinance may have a significant effect on the environment. All interested persons will be given the opportunity to speak at the public hearing. If you challenge the adoption of the ordinance in court, you may be limited to raising only those issues raised at the public hearing described in this notice, or in correspondence delivered to the City Council at, or prior to, the public hearing.
